Probate Law in Little Rock, AR

What is Probate?

Probate is the expensive and time consuming legal process by which the validity of a deceased person’s Will is proven to a judge that also gives a representative appointed in the Will the right to transfer assets out of the deceased person’s name and distribute them according to the terms of the Will or in the absence of a Will, according to applicable state law.

Why a Last Will & Testament Just Isn't Enough

A Will simply outlines your preferences for an estate administrator and your choices as to which of your assets go to whom after your death.  A Will  without additional estate planning documents does not avoid the filing of a probate proceeding and does not ensure that your estate will not be lost to long term care expenses.  Careful estate planning with an attorney experienced in Elder Law and the nuances of Medicaid law can accomplish both.

What Happens Once The Estate Plan is Complete?

Wingfield & Corry, P.A., helps families navigate the legal aspects that come into play after a loved one passes. While estate plans typically focus on transferring property in ways that do not require a probate proceeding, often times there is additional property that was overlooked that does require the filing and administration of a probate.  For decedents that have no Will or other estate planning documents, Arkansas statutes generally require the filing of a probate proceeding in order to transfer the property to the decedent's heirs.  Wingfield & Corry, P.A., also provides probate, estate and trust administration services to heirs and beneficiaries and represents heirs, beneficiaries, estates and trusts in litigation.

Wingfield & Corry, P.A., also assists and counsels clients in maintaining and updating their Wills, trusts and other estate planning documents as their personal situations and family dynamics change.
